This seminar examines the controversial topic of civil disobedience. Here we will consider whether civil disobedience could be an appropriate response to unjust laws in a liberal democracy. We begin by looking at the foundations of government set forth in the writings of John Locke and the Declaration of Independence. Our examination of this topic will then turn to two famous opposing sets of ideas on civil disobedience. By comparing several respective arguments, our aim is to consider whether civil disobedience is compatible with the principles of government as defined by the Declaration of Independence.

This program will be conducted as a discussion, utilizing as the only readings, and with the Discussion Leader facilitating the conversation, instead of lecturing or presenting. This seminar explores three different views in American history and thought about the relationship between liberty and equality.

The U.S. Constitution makes no mention of political parties, yet parties began to form shortly after its ratification. Parties formed as decentralized political associations that engaged the attention of ordinary citizens and held presidents accountable to local constituencies. But as the power of the president (and the federal government) grew, parties shifted their attention from building political support in the states and localities to vying for control over the national administration. Partisan disputes have more often than not involved confrontations between the president and Congress that have undermined the public’s respect for American political institutions.

Native Americans occupy an anomalous position in the United States. Federally recognized tribes each are separate sovereigns within the federal system. States hold no authority over them except what Congress may give them. Their enrolled members are dual citizens of the United States and of their tribal nation. By virtue of the Constitution and the federal government’s responsibilities towards them, it means the government can do things for and to Native Americans that it cannot do to any other citizen. This seminar will examine this situation in both historical and contemporary context.
